AfriPearl — Terms of Service

Version: V4 Effective date: 2026-10-06 Operator: Benoît Sartre, entrepreneur individuel (micro-entrepreneur) SIRET: 915 385 124 00010 Registered address: 66 Avenue des Champs-Élysées, 75008 Paris, France Contact: contact@afripearl.com

1. Introduction

Welcome to AfriPearl (the "Service"), operated via the website afripearl.com (the "Platform").

The Service allows men and women from around the world to connect with the goal of building serious, long-term relationships and, where applicable, marriage.

By creating an account, you ("the User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated from France. These Terms are governed by French law, without prejudice to any mandatory consumer protection provisions applicable in your country of residence.

2. Eligibility

To use the Service, you must:

Be at least 18 years old (or the age of majority in your country of residence, whichever is higher)
Have the legal capacity to enter into binding contracts
Not be prohibited from using the Service under any applicable law
Not be a resident or citizen of the United States of America (see Section 14)

By creating an account, you confirm that you meet all these conditions. Age is self-reported during registration, and the Platform enforces the 18+ minimum stated above at the time of account creation. This age confirmation is separate from the optional identity verification described in Sections 3.2 and 3.3, which uses a government-issued document but does not itself extract or verify date of birth.

3. Account creation and verification

3.1 Free account

Registration on the Platform is free for everyone (men and women). A free account allows you to:

Browse all public profiles
Use messaging subject to the access and unlock limits described in Section 5
Update your profile and photos

3.2 Featured Woman status (free, optional)

A woman may apply for Featured Woman status, which provides additional visibility on the Platform.

To obtain Featured Woman status, she must:

Provide explicit written consent for the use of her photos and videos in AfriPearl's promotional content on social media (TikTok, Instagram, YouTube, paid ads, press, etc.) — see Section 7 and the dedicated Consent Form
Provide a valid government-issued ID (national ID card, passport, driver's license, or equivalent)

The ID is used exclusively to verify:

That she is a real person
That the marketing consent comes from the person on the ID
That the profile is not fraudulent

This identity verification does not itself extract or verify date of birth from the document; the 18+ requirement is enforced separately through the age confirmation given at registration (see Section 2).

After verification, the ID document is deleted within 7 days. Only the following metadata is retained:

Verification status: yes/no
Date of verification
Type of document
Country of document
Expiration date (if any)
Verifier (internal admin)

This minimization complies with GDPR Article 5(1)(c).

3.3 Paying Man status (credits)

A man may purchase conversation credits (see Section 5). Purchasing or using credits is not conditioned on identity verification.

Separately, and available to any man who has purchased credits (or who holds an existing Afripearl Premium subscription) and wishes to complete it, Afripearl offers an optional identity verification process using a valid government-issued ID. Where a man chooses to complete it, the ID is used to:

Limit fake profiles
Increase women's safety
Support the credibility of a Verified badge, where displayed
Protect the Platform against abusive behavior

This identity verification does not itself extract or verify date of birth from the document; it is distinct from the age confirmation given at registration (see Section 2).

Where this optional verification is completed, the ID is deleted within 7 days. Only metadata is retained (same fields as Featured Woman, plus paying status active/inactive).

4. Acceptable use

You agree to:

Use the Service only for genuine relationship purposes
Provide truthful information about yourself
Respect other users at all times

You agree not to:

Engage in any commercial activity on the Platform (sale of goods, services, escorting, etc.)
Solicit money, gifts, or any financial benefit from other users
Share content that is sexual, explicit, violent, hateful, discriminatory, or otherwise inappropriate
Harass, intimidate, threaten, or stalk other users
Create fake profiles or impersonate other people
Use automated tools (bots, scrapers, scripts) to access or extract data
Circumvent the Platform's payment, verification, or moderation systems
Use the Service if you are married or in a committed relationship without disclosing it

Users must not engage in, facilitate, aid, abet, encourage, promote, solicit, or otherwise support human trafficking, sex trafficking, sexual exploitation, or the abuse or exploitation of any person. This prohibition applies regardless of whether the conduct occurs on the Platform or is merely arranged, discussed, or referenced through it.

AfriPearl is not, and shall never be, a platform for prostitution, escorting, or any form of paid sexual or financial arrangement. Any user found engaging in such conduct, or in the trafficking, abuse, or exploitation described above, will be immediately and permanently banned, without refund, and may be reported to competent authorities.

5. Paid services (Credits) {#paid-services}

5.1 Free use of the Platform

Women use the entire Platform and messaging free of charge, without limit. Women can browse, receive, initiate, read, send, and reply to messages without restriction and are never charged.
Men may browse and view every woman's profile normally, and read messages in conversations they have unlocked, free of charge.
Every male account may unlock one (1) conversation for free. Unlocking a conversation is an explicit action. Once unlocked, that conversation is unlimited and permanent — the man can exchange as many messages as he likes with that woman, with no further payment.
Likes, profile views, and receiving a message do not consume an unlock. When a woman messages a man he has not unlocked, he is shown that a message exists and by whom, but not its content, until he chooses to unlock. Once the free conversation has been used, unlocking each additional woman requires one credit.
Conversations already unlocked before the Effective date of this version remain unlocked. A man who had already unlocked at least one conversation before that date has used his free conversation.

5.2 Credits (men)

1 credit = 1 unlocked conversation

Credits are prepaid and sold in packs (currently packs of 1, 3, and 10 credits). They are a one-time payment, processed by Stripe. There is no subscription and no automatic renewal.
Using one credit unlocks a conversation with one woman of your choice. That conversation is then unlimited and permanent. A credit is only ever used by your explicit confirmation.
Prices may vary by region. The price of each pack depends on the country from which you access the Platform, as determined by AfriPearl at the time of purchase. The price that applies to you is always displayed before you pay. Circumventing regional pricing (for example by misrepresenting your location) is a breach of these Terms and may lead to review or suspension of the account.
Credits have no expiry date while your account remains active. They are personal to your account, cannot be transferred or exchanged for cash, and are lost if your account is deleted or terminated.
Credits buy the ability to open a conversation. They do not guarantee a reply, a match, or any other outcome.

5.3 Existing Afripearl Premium subscriptions

The Afripearl Premium monthly subscription (9.99 USD per month) is no longer offered for sale. If you already hold an active subscription:

It continues on its existing terms: unlimited conversation unlocks, billed monthly via Stripe until you cancel.
You may cancel at any time from the Stripe Billing Portal. Cancellation takes effect at the end of the current paid period.
After the paid period ends (or if a renewal payment fails and the subscription lapses), every conversation you unlocked remains fully accessible and unlimited. Unlocking an additional woman then requires one credit.

5.4 No guarantee, refunds, and EU right of withdrawal

You acknowledge that AfriPearl does not guarantee any specific outcome (match, relationship, marriage) and does not engage in matchmaking, selection, or recommendation.

Credits that have been used are non-refundable. By using a credit, you ask AfriPearl to provide the service immediately (the conversation is unlocked at once) and you acknowledge that the service paid for with that credit has been fully performed.

Refunds are otherwise subject to mandatory consumer law. If you are a consumer residing in the European Union or European Economic Area, you may have a statutory right of withdrawal of 14 days from the date of purchase under EU Consumer Rights Directive 2011/83/EU, which you may exercise for credits you have not yet used. The effect of using a credit on your withdrawal right depends on the applicable law and on the specific consent or acknowledgment obtained from you; AfriPearl does not claim to override mandatory consumer protection law through these Terms. To ask about a refund or to exercise any applicable withdrawal right, email contact@afripearl.com.

5.5 Payment

Payments are processed by Stripe. By paying, you accept Stripe's own Terms of Service.

AfriPearl never stores your full credit card information. AfriPearl only stores the transaction ID, the amount paid, the date, the pricing tier, and the last 4 digits of the card (via Stripe).

All prices are displayed and charged in US Dollars (USD) and may vary by region (see Section 5.2). Local taxes (VAT, etc.) may apply depending on your country of residence and will be displayed at checkout.

6. Featured Woman compensation

A Featured Woman receives no salary, no commission, and no contractual payment from AfriPearl.

In recognition of the use of her image and her time, she may receive occasional discretionary goodwill gestures from AfriPearl (for example, a contribution to her phone bill or a gift). These gestures, where offered, are unrelated to any date, introduction, match, message, or in-person meeting, are never contractual, and never represent a salary or fixed compensation.

A Featured Woman is never required to accept any introduction request, to engage in any conversation, or to meet any user in person. She remains free at all times.

7. Image rights and marketing use (Featured Woman)

By accepting Featured Woman status, you grant AfriPearl a non-exclusive, worldwide, transferable license to use your photos, videos, voice, and first name (or chosen pseudonym) for promotional purposes on:

The afripearl.com website
AfriPearl social media accounts (TikTok, Instagram, YouTube, Facebook, X)
Paid advertising campaigns
Press content and editorial articles

This license is granted for a duration of 5 years, automatically renewable for one additional 5-year period unless you withdraw your consent in writing.

You may withdraw your consent at any time by emailing contact@afripearl.com. Upon withdrawal:

Your profile is removed from the Platform within 7 days
Your image is removed from AfriPearl's direct marketing content within 30 days
Content already redistributed by third parties (reposts, screenshots) cannot be guaranteed to be removed

Withdrawal does not affect the legality of processing carried out before the withdrawal.

A detailed Consent Form is provided separately and signed by each Featured Woman before activation.

8. Privacy and personal data

Your personal data is processed in accordance with our Privacy Policy (available at /privacy), which is an integral part of these Terms.

The Platform is GDPR-compliant. You have rights of access, rectification, erasure, restriction, portability, and objection. To exercise them, email contact@afripearl.com.

9. Content moderation

AfriPearl reserves the right to:

Review, edit, or remove any profile, photo, message, or content that violates these Terms
Suspend or permanently ban any user found in breach of these Terms, without refund
Cooperate with law enforcement in case of suspected illegal activity

AfriPearl does not actively monitor private chat content but may review reported content. Users are encouraged to report any abuse via contact@afripearl.com.

10. Liability

10.1 AfriPearl's role

AfriPearl is only a technical platform that allows users to connect. AfriPearl:

Does not introduce users to each other; users independently browse profiles and choose which profiles they wish to contact or unlock
Does not engage in matchmaking, selection, or curation of profiles
Does not guarantee the truthfulness of information provided by users
Is not responsible for the conduct, statements, or decisions of any user
Is not responsible for any romantic, financial, legal, or other outcome of interactions between users
Is not responsible for any in-person meeting between users, whether organized via the Platform or not

10.2 Limitation of liability

To the maximum extent permitted by law, AfriPearl's total liability is limited to the amount paid by the user during the last 12 months.

AfriPearl shall not be liable for any indirect, consequential, special, or punitive damages.

10.3 Force majeure

AfriPearl is not liable for any failure or delay due to events beyond its reasonable control (natural disasters, war, pandemics, telecommunications failures, etc.).

11. Account suspension and termination

11.1 By the user

Your account remains active until you choose to delete it. There is no automatic expiry date for standard user accounts.

You may delete your account at any time via the Platform settings or by emailing contact@afripearl.com. Account deletion is effective within 30 days. Any existing paid subscription must be canceled separately before account deletion to avoid further billing. Unused credits are lost when the account is deleted.

11.2 By AfriPearl

AfriPearl may suspend or terminate your account at any time, with or without notice, if you breach these Terms, applicable law, or engage in conduct harmful to other users or to the Platform.

In case of termination for breach, no refund is granted.

12. Modifications to these Terms

AfriPearl may update these Terms at any time. Material changes will be notified to users by email and/or via a notice on the Platform at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.

Previous versions of these Terms are available upon request by emailing contact@afripearl.com.

13. Dispute resolution

13.1 Amicable resolution

Before any legal action, both parties agree to attempt amicable resolution by email within 30 days.

13.2 Consumer complaints

For any complaint concerning the Service, users should first contact Afripearl at contact@afripearl.com.

13.3 Competent jurisdiction

These Terms are governed by French law. The competent court is the court of the Operator's place of business in Paris, France, except where mandatory consumer law provides otherwise.

14. United States residents

The Service is not available to residents or citizens of the United States of America.

This restriction is due to the regulatory framework of the International Marriage Broker Regulation Act (IMBRA, 2005), which imposes specific obligations (federal background checks, sex offender registry checks, translated consent disclosures, etc.) that AfriPearl does not currently support in V1.

If you are a US resident or citizen, you must not create an account on the Platform. Any account identified as US-based may be suspended without notice and without refund.

A future version of the Service may be made available to US residents under a fully IMBRA-compliant framework.

15. Miscellaneous

Severability: if any provision of these Terms is held invalid, the remaining provisions remain in full force.
No waiver: failure by AfriPearl to enforce any provision does not constitute a waiver of that provision.
Entire agreement: these Terms (together with the Privacy Policy and Cookie Policy) constitute the entire agreement between you and AfriPearl regarding the Service.
Assignment: AfriPearl may assign these Terms to a successor entity (e.g., upon incorporation of a French company). Users will be notified.
